Consultation on correcting references in the Food Safety Act 1990

Food Standards Scotland (FSS) is consulting on proposals to amend the Food Safety Act 1990 to fix a minor deficiency which has arisen now that the UK is no longer a member of the European Union.

The regulations will replace a reference to “EU” law with “assimilated” law.  Assimilated law is the new name for law derived from our previous membership of the EU.  This is a purely consequential amendment and it does not change policy or obligations under food law. 

The proposed GB Statutory Instrument also includes an amendment to the Food Standards Act 1999.  As that Act does not apply in Scotland, those provisions can be ignored.
