Q 4. Would the crime of substitution apply if a restaurant lists a brand name product on a menu but substitutes it with a cheaper alternative?’

Q 1. Food Standards Scotland has not reported an ingredient substitution crime to the Crown
Office and Procurator Fiscal Service.
Q 2. Not applicable.
Q 3. If a business is found to be substituting an ingredient this would be fully investigated.
Q 4. It would constitute an offence if a restaurant lists a brand name product on a menu but
substitutes it with a cheaper alternative.
